Dual Legal Strategy Secures Eviction and Financial Recovery for Landlord Client

Overview

JC Paralegal represented landlords Jessica and Marcio Blanc in two coordinated applications before the Landlord and Tenant Board (LTB) concerning the same tenancy at 88 Park Lawn Rd, Etobicoke.

The landlords faced serious issues, including illegal activity, property damage, interference with the enjoyment of the premises, and significant rent arrears. To protect their interests, JC Paralegal pursued a two-pronged legal strategy — one application addressing tenant conduct and another ensuring financial recovery.

The Challenges

  • Application 1 (LTB-L-045831-25-IN):
    Allegations of illegal acts, wilful or negligent damage, interference with reasonable enjoyment, and unpaid NSF charges required immediate action and detailed evidence preparation.
  • Application 2 (LTB-L-050478-25):
    Tenants had also failed to pay $10,829.23 in rent arrears, plus NSF fees, and were absent from the hearing despite proper service.

The goal: Terminate the tenancy, recover arrears, and preserve the landlord’s right to claim damages at a later hearing.

Our Approach

JC Paralegal:

  • Filed two distinct LTB applications under Sections 16.1 and 69 of the Residential Tenancies Act, 2006
  • Represented the landlords in virtual hearings
  • Negotiated a consent-based interim order in the first matter to secure timely termination
  • Proceeded ex parte (without tenants) in the second hearing to finalize arrears
  • Ensured proper documentation, disclosure, and procedural compliance for both matters

Results

  1. Tenancy Terminated:
    Both LTB orders confirmed termination of the tenancy effective August 10, 2025 at 12:00 p.m.
  2. Eviction Authorized: If the tenants failed to vacate, JC Paralegal obtained authorization to file the order with the Sheriff starting August 11, 2025 for enforcement.
  3. Rent Arrears & Costs Awarded: A final order required the tenants to pay $11,123.23, including rent arrears, NSF fees, and application costs.
  4. Next Hearing Secured: The first application was adjourned for a future hearing, allowing the landlords to pursue additional claims for damages and loss of enjoyment.
  5. Full Compliance Strategy: Disclosure deadlines and evidence preparation were ordered to support ongoing proceedings.
